Shipping and Returns

Thank you for visiting and shopping at Tracheostomy Education.

Tracheostomy Education Academy has a 30 day money back guarantee should you be unhappy with the service in your first month of membership. To request a refund, please cancel your subscription via your accounts page or email [email protected] within the 30 day window.  No refunds will be made for any membership fees already paid, excluding the 30 day money back guarantee as stated above.  Upon canceling, you will no longer have access to the service including all content and community once your current membership is complete. The 30 day refund period only applies to your first subscription and cannot be used more than once.  No partial refunds are given should you terminate the annual subscription before your renewal, however you will retain access to the service until the end of your annual payment term. It is entirely your responsibility to ensure that you cancel your account in good time should you no longer require the service and do not wish to be billed further. You must complete the course within the time frame indicated at enrollment. Course access will automatically expire after that time.

If for any self study course, the program is cancelled, you will be provided with 30 days to complete the course.  You can request a full refund or credit toward another course of similar value if cancellation is 6 months or less from sign up. 

For any live events, if the program is cancelled, the payment will be refunded in full. If the program is rescheduled, the participant will have the option of a refund or attending the course at the new time.  Participants are encouraged to purchase travel insurance as refunds are not provided for travel arrangements.

We offer a 30 day return period for other products in our store.  Please contact us if any incorrect or damaged items at [email protected] and we will correct the issue. We do not offer refunds or exchanges for incorrect sizes for clothing.  All clothing is printed on demand.  We do not offer returns on music once opened in order to protect intellectual property.  If the media is unopened, we offer a 30 day return period.  Returns for the Tracheostomy Manikin and Megabee requires a 20% restocking fee plus shipping.

Digital downloads: There are no returns on any downloads.

The Breather:   The Breather is a single patient use device. As such, returns of working devices are not accepted.  PN Medical, Inc. (“PN Medical”) warrants that its “The Breather” products (“Products”) will be free from manufacturing defects for one (1) year from the date of purchase. Tracheostomy Education is a PN Medical-authorized retailer.  The one year warranty applies to Products that were purchased from Tracheostomy Education, unless otherwise prohibited by law. PN Medical Products are legitimately sold only by authorized sellers who are required to follow PN Medical policies, procedures, and quality control standards.  This warranty does not cover any defects due to normal wear and tear, damage due to misuse, alteration to the product, or negligence.

Trachie-O-Potamus’s Big Race- It takes 1-2 days to fullfill an order, after which it’s shipped out. The shipping time depends on your location but can be estimated as follows:

USA: 2-8 business days.                      International: 10-20 business days

Finding Your Voice-Songs for Kids with Trachs, Animal Face Cut-Outs, Trach Add Ons- It takes 1-2 days to fullfill an order, after which it’s shipped out. The shipping time depends on your locations, but can be estimated as follows:

International: 10-20 business days

Clothing, mugs and stickers-  It takes 2-7 days to fulfill an order, after which it’s shipped out. The shipping time depends on your location, but can be estimated as follows:

USA: 3-6 business days
International: 10-20 business days. 

Tracheostomy Manikin- The Clearview Tracheostomy Manikin takes 1-2 days to fullfill an order, after which it’s shipped out.  The shipping time depends on your location, but can be estimated as follows:

**Service is subject to shipping delays. Delivery times are estimates, and not guarantees. Delivery estimates for all international services do not include customs processing times. Our store is not liable for any delays that may occur once your order has been shipped.

Digital downloads:

You are free to download a digital copy and print a copy for soley for your noncommercial purposes. You must not under any circumstances: publish, republish, sell, license, sublicense, rent, transfer, broadcast, or redistribute the digital information in part or whole in any way. You may not edit, adapt, alter the downloads in any way.  You may not use the digital downloads in any way that is unlawful or in breach of any persons legal rights.  You may not use the digital downloads in any way to compete with us either directly or indirectly. You may not use the digital downloads for a commercial purpose.

Tracking Your Order

Once your order has shipped, you will receive a tracking email within 24 hours. Please allow [USPS/UPS/Fedex] up to 48 hours to reflect updates on their tracking page.

Customs, Duties, and Import Taxes

All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).

Tracheostomy Education provides a community where people can post questions and receive responses. Those that contribute to the community at Tracheostomy Education in any way agree to not disclose protected health information (PHI) under the guidelines of HIPAA. All users of Tracheostomy education agree to abide by the state’s HIPAA laws and not disclose anyone’s protected health information. Tracheostomy Education is not responsible or liable for any intentional or unintentional disclosure of HIPAA and/or protected health information (PHI). Tracheostomy Education disclaims any and all liability from any disclosure of protected health information under HIPAA laws from members and/or nonmembers and users of its website. Tracheostomy Education has no control over users of the website’s actions or inactions.

Mitigation of Harm. In the event of a use or disclosure of PHI that is in violation of the requirements of this Agreement, we will mitigate, to the extent practicable, any harmful effect from the violation. Such mitigation will include: Reporting any use or disclosure of PHI not provided for by this Agreement and any security incident of which we become aware of the user; and documenting such documenting such disclosures of PHI and information related to such disclosures as would be required for use to respond to a request for an accounting of disclosures of PHI in accordance with HIPAA.

As provided in the Agreement, we will make available to users, information necessary for user to give individuals their rights of access, amendment, and accounting in accordance with HIPAA regulations.

Upon request, we will make our internal practices, books, and records including policies and procedures, relating to the use and disclosure of PHI received from, or created or received by the Agreement on behalf of a user available to the user or the Secretary of the U.S. Department of Health and Human Services for the purpose of determining compliance with the terms of this Agreement and HIPAA regulations.

Our store is hosted on WooCommerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

5.6    We will not be liable to you in respect of any loss or corruption of any data, database or software.

5.7    We will not be liable to you in respect of any special, indirect or consequential loss or damage.

5.8    You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the website or these terms and conditions (this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees).

15.4 In no case shall Tracheostomy Education, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
